Aspire (“the app”, “we”, “us”, “our”) is a bilingual (Welsh and English) information and support service created with and for care-experienced young people in Wales. Aspire is provided by Night Mode Ltd, a company registered in Wales, whose registered address is GCNG House, Unit 12, Swansea SA7 9LA (“the provider”).
These Terms of Service (“the Terms”) govern your use of the Aspire mobile application and the website at aspire.wales (together, “the Service”). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Aspire is provided in partnership with local authorities and other organisations across Wales. Access to the app is arranged through your local authority.
Who can use Aspire
Aspire is designed for care-experienced young people aged 16 and over. The app is invite-only: you can only access it if you have been issued with a user account through a participating local authority.
You may use the Service only if:
Your account gives you access to content relevant to your local authority area. You must not attempt to access content, accounts or areas of the Service that you have not been given permission to use.
Your account and access
You are responsible for keeping your login details secure and for activity that takes place under your account. If you think someone else has gained access to your account, please tell your local authority contact or email us at support@nightmode.studio as soon as possible.
Your local authority manages who is given access to Aspire and may suspend or remove access in line with their own processes. We may also suspend or end your access where necessary to protect the Service or other users, or where these Terms are breached.
What Aspire does
Aspire gives you access to information and guidance on topics, such as money, housing, education, work, relationships, health and wellbeing. It includes written resources, stories and case studies, and an AI chat assistant.
The information in Aspire is curated in partnership with your local authority and is intended to be helpful and relevant to your area. However, the Service is an information and signposting tool. It does not replace professional advice or support from your social worker, personal adviser, a medical professional, or any other qualified person.
Aspire does not allow you to contact or chat with other users. It is not a social network or messaging service.
The AI chat assistant
Aspire includes an AI chat assistant that helps you find and understand information. The assistant prioritises responses from Aspire’s own approved, local knowledge base rather than the wider internet, and includes built-in safety features.
When using the AI chat assistant, please understand that:
In an emergency, always call 999. If you need urgent support, please contact your social worker, personal adviser, or an appropriate support service.
Safeguarding and your safety
Your safety matters to us. The AI chat assistant includes safety filters designed to recognise when someone may be at risk and to respond by signposting to appropriate support.
Acceptable use
When using Aspire, you agree not to:
We may suspend or end access for anyone who breaches these rules, in coordination with the relevant local authority.
Content and intellectual property
The Service, including its design, text, stories, case studies, software and other content, is owned by Night Mode Ltd or its partners and licensors, and is protected by intellectual property law. You are given a personal, non-transferable right to use the Service for your own information and support while you have an active account.
Some content is provided by, or signposts to, third parties (for example, local authorities and support organisations). We are not responsible for the content of external services that we link to.
Privacy and your data
Aspire is designed to collect as little personal data as possible. We do not gather special category (sensitive) personal data within the app content, and the app does not let users contact one another. Limited identity information is used to manage secure, invite-only access through Microsoft Entra ID.
How we handle personal data is explained in our Privacy Policy, which forms part of these Terms. Please read it alongside this document.
Availability of the Service
We work to keep Aspire available and up to date, but we do not guarantee that the Service will always be available, uninterrupted, or error-free. We may update, change, suspend or withdraw parts of the Service from time to time, including during the pilot phase, as the app continues to be developed.
Disclaimers and our liability
The information in Aspire is provided for general guidance and signposting. While we take care to keep content accurate and relevant, we do not warrant that all information is complete, current or suitable for your particular circumstances. You should always check important matters with a qualified professional.
To the fullest extent permitted by law, Night Mode Ltd is not liable for any loss or damage arising from your reliance on information provided through the Service, or from your inability to access the Service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law (including liability for death or personal injury caused by negligence, or for fraud).
Changes to these Terms
We may update these Terms from time to time, for example as the app develops or to reflect legal or partnership changes. When we make significant changes, we will update the “Last updated” date at the top and, where appropriate, let users know through the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales.
